Terms of Service

A referral does not guarantee an interview, job, offer, selection, or response from the company.

1. Agreement and platform role

These Terms of Service ("Terms") govern your access to and use of FindMyReferral ("Platform," "we," "us," or "our") at findmyreferral.com and related services. By creating an account or using the Platform, you agree to these Terms, our Privacy Policy, Refund Policy, and other policies linked on the site.

FindMyReferral is a two-sided referral marketplace that connects job seekers ("Hunters") with verified current employees ("Referrers") for paid referral support. We facilitate discovery, requests, payments, chat, proof of referral submission, and dispute resolution. We are not an employer, recruiter, staffing agency, or guarantor of hiring outcomes.

2. Important disclaimer — no hiring guarantee

A referral does not guarantee an interview, job, offer, selection, or response from the company. You are paying for referral support or referral submission effort by a verified employee, not for employment outcomes. The employer alone decides whether to review, shortlist, interview, or hire any candidate. We do not promise that a Referrer will accept your request, that chat will lead to a referral, or that a submitted referral will be acted upon by the company.

3. Definitions

"Hunter" means a user seeking referral support for a specific job or company. "Referrer" means a verified current employee who offers referral support through the Platform. "Referral Request" means a transaction connecting one Hunter, one Referrer, one target company, and one job. "Escrow-style holding" means funds are recorded in our internal pending earnings ledger until referral work is completed or a dispute is resolved — this is not a regulated escrow bank account. "Platform fee" means our commission on successful transactions, currently 25% of the gross payment unless otherwise disclosed at checkout.

4. Eligibility and accounts

You must be at least 18 years old and legally able to enter a binding contract. You must provide accurate, current information and maintain one account per person. Hunters sign in with a verified personal email via one-time password (OTP). Referrers additionally verify a current corporate work email, submit a LinkedIn profile, and complete admin review before appearing in search.

You are responsible for safeguarding your login credentials and for all activity under your account. We may suspend, restrict, or terminate accounts that violate these Terms, our Acceptable Use Policy, Hunter Code of Conduct, Referrer Code of Conduct, or applicable law. Admin may require re-verification if employment status changes.

5. Hunter responsibilities

Hunters must provide accurate job details (company, title, job link, job ID where applicable, location, and relevant context), communicate professionally in chat, upload resumes and files only for legitimate referral purposes, and pay the disclosed amount after a Referrer accepts a request. Payment is required before chat unlocks.

Hunters must not share false credentials, bypass the Platform to pay Referrers directly, harass Referrers, or raise disputes in bad faith. Hunters should review referral proof promptly and either confirm completion or raise a valid dispute within the review window. Failure to respond after proof upload may result in auto-completion as described in our completion flow.

6. Referrer responsibilities

Referrers must be current employees of the company they represent, maintain accurate profile and fee information, respond to requests in a timely manner, and follow their employer's internal referral policies. Referrers may accept, reject, or ask for clarification before payment — they are not obligated to accept every request.

After payment, Referrers must communicate professionally, review candidate materials, submit an internal referral where appropriate, and upload valid referral proof with confidential company information redacted. Referrers must not share internal recruiter emails, employee IDs, confidential portal details, compensation data, or private company documents in chat or proof uploads. Referrers must not solicit off-platform payment or misuse Hunter resumes.

7. Referrer verification and anonymous profiles

Referrer profiles go through corporate email OTP verification, LinkedIn review, and manual admin approval. Until approved, Referrers do not appear in company search. Approved Referrers are shown to Hunters as anonymous profiles displaying company, role category, ratings, fees, and availability — not real name, personal email, corporate email, phone, LinkedIn URL, or bank details before the appropriate stage.

Admin may approve, reject, suspend, or require re-verification. We may remove Referrers who no longer work at the claimed company, provide misleading information, or receive repeated disputes or low trust signals.

8. Referral requests and service scope

A Hunter creates a Referral Request with job and candidate details. The Referrer reviews and may accept, reject, or request clarification. Payment is generated only after acceptance. The Platform's service is complete when the Referrer has performed agreed referral support — typically reviewing materials, submitting a referral internally where appropriate, and uploading acceptable proof — not when the candidate receives an interview or job offer.

Request statuses, chat access, and file sharing follow Platform rules: chat and full resume access remain locked until payment is confirmed.

9. Payments, fees, and Razorpay

Payments are processed through Razorpay. By paying, you agree to Razorpay's terms and applicable payment network rules. The final amount, including the Referrer's fee and Platform commission, is shown before you pay. We use Razorpay Orders/Checkout and verify payments via server-side signature checks and webhooks before unlocking chat or recording earnings.

All amounts are in Indian Rupees (INR) unless otherwise stated. You authorize us to record payment, allocate Platform commission (currently 25%), and credit the Referrer's pending earnings ledger entry. Failed, duplicate, or unauthorized payments may be reversed or refunded per our Refund Policy.

10. Escrow-style fund holding

When a Hunter pays, funds are received by the Platform and the Referrer's share is held as pending earnings — not immediately withdrawable. Pending earnings release when: (1) the Referrer uploads acceptable proof, (2) the Hunter confirms completion, (3) the auto-completion period (currently 5 days after proof upload) passes without dispute, or (4) admin releases funds after review.

Funds are frozen when a dispute is raised, payment mismatch is suspected, proof is missing or disputed, fake activity is suspected, or admin flags the request. The Platform may hold funds during disputes; see our Dispute Policy and Refund Policy.

11. Chat, files, and proof

After payment, Hunters and Referrers may exchange messages, job links, resumes, and permitted files through Platform chat. Files must comply with size and format limits (PDF, DOC, DOCX for documents; PNG/JPG for proof images). Resumes and uploads are stored in private storage with access controls and signed download URLs — not in public buckets.

Referrers upload referral proof (e.g., portal confirmation, referral email screenshot, tracking ID) confirming submission date, job, and company, with sensitive internal data hidden. Hunters may confirm receipt or dispute within the stated window.

12. Completion, auto-completion, and ratings

Normal completion: Referrer uploads proof → Hunter reviews → Hunter confirms "Referral Received" → request completes → pending earnings become available to the Referrer → Hunter may rate the Referrer.

Auto-completion: If the Hunter does not confirm or dispute within the auto-completion period (currently 5 days) after proof upload, the system may mark the request completed and release pending earnings. After completion, Hunters may rate Referrers on responsiveness, professionalism, referral completion, guidance, and overall experience.

13. Referrer earnings and withdrawals

Referrers see pending earnings, available earnings, withdrawn earnings, and payout history in their dashboard. Available earnings may be withdrawn subject to verified status, sufficient balance, no active disputes on related requests, valid payout details, and admin approval. MVP payouts may be processed manually. We may delay or deny withdrawals involving fraud, disputes, or policy violations.

14. Disputes and refunds

Either party may raise a dispute during active referral work. Disputes freeze pending earnings until admin review. Admin may refund the Hunter, release earnings to the Referrer, apply a partial resolution, suspend a user, or request more evidence based on payment records, chat, files, proof, and request history.

Refund eligibility and exclusions are defined in our Refund Policy. By using the Platform, you agree that admin decisions on disputes and refunds are binding for Platform purposes, subject to applicable law.

15. Prohibited conduct

You may not create fake profiles, impersonate others, scrape or harvest data, circumvent Platform payments, spam, harass, discriminate, upload malware, share others' confidential data without authorization, or use the Platform for any unlawful purpose. See our Acceptable Use Policy, Hunter Code of Conduct, and Referrer Code of Conduct for details. Violations may result in content removal, suspension, permanent ban, and referral to authorities where appropriate.

16. Intellectual property and license

The Platform, branding, software, and content we provide are owned by FindMyReferral or our licensors. You retain ownership of content you upload but grant us a limited license to host, process, and display it as needed to operate the marketplace, verify users, process payments, resolve disputes, and comply with law. You represent that you have rights to content you upload.

17. Disclaimers and limitation of liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR REFERRER PERFORMANCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDMYREFERRAL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR HIRING OUTCOMES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR (B) INR 5,000.

18. Indemnification

You agree to indemnify and hold harmless FindMyReferral from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your breach of these Terms, your violation of employer policies, or your dispute with another user, except to the extent caused by our gross negligence or willful misconduct.

19. Changes, termination, and governing law

We may update these Terms by posting a revised version with a new "Last updated" date. Material changes may be notified by email or in-app notice. Continued use after changes constitutes acceptance.

You may stop using the Platform at any time. We may suspend or terminate access for violations or operational reasons. Provisions that by nature should survive (payment obligations, disputes, liability limits, indemnity) survive termination.

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to mandatory consumer protections in your jurisdiction where applicable.
